Editorial: Coverage of Queens hate-crime sentencing

The trial of the second defendant in a Queens, N.Y., bias attack has come to a close, but news outlets are showing some bias of their own in their reports on the sentencing.
Paul Heavey, 21, got off with five years of probation and 75 hours of community service for the attack in the Douglaston neighborhood last August. He and 19-year-old Kevin Brown rammed a car carrying four Chinese American teens and then beat two of the occupants when they got out to check the damage, at one point using a metal wheel lock that victim Reynold Liang had taken up in self-defense. All throughout, the two shouted racial slurs like “stupid gook” and statements like “get out of our neighborhood.” (In March, Brown was sentenced to three and a half years in prison for his role.)
As part of his sentence, Heavey was required to make an apology, which we would guess is a standard, token gesture for a trial like this. But an overwhelming number of news sources are giving undue weight to Heavey’s words, as you can see in these headlines by New York-area outlets:

“Little Neck man apologizes for Doug hate attack”: Times Ledger
These headlines gloss over the lightness of the sentence and seem to imply that Heavey exonerated himself with his apology, as if that’s all the victims could have hoped for or deserved. And they overlook that the apology was mandatory. Seriously, how sincere could the statement have been, under the circumstances? At the very least, it wasn’t “offered,” as WNBC put it.
Also, check out this header that a few outlets, including the globally distributed International Herald Tribune, are carrying:

Again with the offering. And is that his designation, “college student”? That almost makes you think Heavey was wearing a cardigan and carrying an armload of books when he decided to attack the teens.
Maybe these news outlets think rehabilitation starts with the reporting.

The “apology” was court mandated. How much “remorse” could Mr. Heavey really have?

“The NY Times talks to Queens residents who have differing perspectives on the likelihood of racial attacks - some are shocked while others aren’t, given the explosion of new residents and Liang gave them a good quote to end their article on: ‘I definitely don’t want this to happen to anybody else. Queens is a nice area. It’s my home.’”
Take a moment to digest that.
We as a community, have to hold our elected representatives, our courts, the media, and the perpetrators accountable for these hate crimes. We belong here, we’re Asian-AMERICANS and this is our home.

Stop thinking that someone else will do the right thing or take action if no one speaks up and takes the initiative to push for justice. We have to put pressure on decisionmakers to ensure that Asian-Americans get an equitable opportunity for justice. It has to happen if we’re not satisfied with the status quo.

What miraculous epiphany can these attackers have so suddenly that they are sorry for thinking that these “chinese bastards are so irritating that I have an urge to *** and then do so accordingly.
Though injustice is present, commenters shouldn’t be so quick to adopt the “asians versus everybody else” mentality. With strong factioning and a thirst for justice by means of tit for tat, we can now have 2 white men beaten up with some chinese calling them “God damn white barbarians, this is what you get, eat it yeah!”
You might say, “noooo, factioning wont get to that point” and it may not. But as soon as you tie all asians in as “some gang prone community who meets all infractions with a united effort to correct such infraction. Though it may not be through violence,” such mentality will strengthen any barrier thats already existing between Asians and the would be “Enemy’s Race.” A barrier not all asians are happy to endorse.
The meek asian may be a stereotype that “power-to-the-asian-people” crew may want to stomp. But don’t do it at the cost of creating another stereotype. That, Asians are generally not level headed individuals, who will be quick to anger when dealing with non asians for the fear that they are about to be discriminated against.
These asian men should have met the situation not in the name of asians but just as any man or woman would. “Some maniac rams into you and is about to whoop you and your friends ass or kill you. You should defend you and your group at any costs to the attacker but only to him.
If that requires force to disable him, and you have the means. Then don’t hesitate.
If the man is 2x larger than you and you don’t have the means, don’t do the macho thing. Don’t act tough like you have an obligation to defend the asian manliness. You know you aren’t surviving that first hit, and you know that even as a highly persuasive, ultra reasonable, peace loving, person that you are, will not be able to talk two 250 pound lunging males into halting to think things over. First bet is to run the hell away as it would still be better than getting stomped, but do so only if everyone can run away. If thats not possible. The macho thing would be a standard brawl even against greater odds and even if you will lose. Some may say toughen up so the odds are even. But in a non barbaric society, people should not be required to physically toughen up to take a beating at any given moment. We shouldn’t have to live in fear. What does one do then, one of the four guys should have dealt a cheap easy fatal blow from behind that guarantees results. Some may say that is barbaric in itself but you may not have the liberty to just disable him and he wont listen to reason. So it is either your friend’s carcass or the aggressor’s.
This will show a strong committment to your friend’s safety, albeit using what many would suggest is a cowardly method.
Some may say, “oh it takes violent person to resort to instantly killing an attacker who may not even end up killing you and your friends,” But then you fail to understand, what if the aggressor is going after your kid, or your girlfriend. That would make the “can’t survive the first hit thing, more apparent. And so would “by macho standards”, your Duty as a man, or if you are a woman, not your duty but ask yourself, do your party want to leave alive?
All you need to do is explain that to the jury and have them believe you. Because killing aggressors too quickly in america may automatically land you as the bad guy, unfortunately. Especially if you aren’t from the stereotypical race who regularly must defend themselves against the race that is stereotypically prone to violence. Such is the reality of the matter. But this should be taken with a grain of salt as reading too much into these purported negative stereotypes would make some people highly scornful.
One would in the process develop stereotypes for the ones purportedly prone to the suggestions of stereotypes in the first place. For instance, “Ugh those white people so easily fooled by asian stereotypes.” Now, I KNOW the commenters around here are too smart to fall prey to that.

In any fight the typical standard is for police to assess who the victim is from the aggressor based on the extent of the injuries. It is important to note that this was 4 men vs. 2 men and that the 4 men actually admit to bringing a weapon into the melee. This part of the story gets glossed over for the sake of political and racial debate, which have nothing to do with the fight that ensued on that evening.
