    REP. HONDA EXPRESSES OUTRAGE OVER 92.3 FREE FM RACIST AND SEXIST RADIO SEGMENT

    Washington, DC - Congressman Michael Honda (CA-15), Chair of the Congressional Asian Pacific American Caucus (CAPAC), issued the following statement today regarding a recent segment of CBS Radio’s “The Dog House with JV & Elvis,” that involved a prank call to a Chinese restaurant:

    “The prank call made by radio personalities JV and Elvis to a Chinese restaurant perpetuated dangerous sexualized racist stereotypes about Asian Americans and showed insensitivity to the immigrant experience. In the segment, the caller, with a computerized voice, asked the restaurant’s female employee, ‘Should I come to your restaurant so that I can see you naked? .. . . That way, I can see your hot Asian spicy *ss.’ He told another employee, ‘I need shrimp flied lice’ and ’some old dung.’ The caller said to this male employee, ‘Chinese man, tell me about your tiny egg roll . . . your tiny egg roll in your pants.’ The radio hosts ended the call with: ‘Tell the hot Asian girl that answered the telephone, I would like to tap her *ss.’

    “The segment first aired on April 5 - only one day after Don Imus referred to the Scarlet Knights, the Rutgers University women’s basketball team, as ‘nappy-headed hos.’ What is outrageous is that after CBS rightly fired Don Imus on April 12, the segment was aired again on April 19.

    “Currently CBS Radio’s sanction, suspension of the radio co-hosts, is a mere slap on the wrist. Mainstream networks should understand the wide influence they wield, and take responsibility to combat rather than perpetuate racial and sexual stereotypes. I call for an apology by CBS and CBS Radio and the immediate firing of JV and Elvis and the show’s producer.”

    I watched the FOX News program, and you handled yourself very well, with composure, even though you were in a hostile territory. While the questions they asked were leading questions biased against you, you maintained your equanimity.

    In terms of how to fight back on their argument based on the Freedom of Speech, I suggest that you consider the following counterargument:

    JOKES AGAINST CHINESE AMERICANS THAT ARE GOOD NATURED HUMORS ARE ACCEPTABLE, AND ARE PROTECTED BY THE FIRST AMENDMENT TO THE UNITED STATES CONSTITUTION.

    CBS RADIO’S JOKES ARE “INDECENT” IN VIOLATION OF FEDERAL LAWS AND FCC REGULATIONS.

    HAVEN’T YOU HEARD OF THE COMMUNICATIONS ACT OF 1934? HAVEN’T YOU STUDIED THE PACIFIC CASE DECIDED BY THE UNITED STATES SUPREME COURT IN 1978? (See FCC v. Pacifica Foundation, 438 U.S. 726 (1978).

    AS AN AMERICAN, YOU SHOULD AGREE WITH US, THE CHINESE AMERICANS, THAT THE UNITED STATES CONGRESS HAS THE AUTHORITY TO REGULATE THE BROADCAST OF INDECENT MATERIALS, AND THAT THE FCC HAS THE AUTHORITY TO INTERPRET AND IMPLEMENT THE FEDERAL STATUTES PASSED BY THE CONGRESS — COMMUNICATIONS ACT OF 1934 AND PUBLIC TELECOMMUNICATIONS ACT OF 1992.

    ARE YOU TELLING ME THAT YOU DISAGREE WITH OUR GOVERNMENT STRUCTURE, AND THE CHECKS AND BALANCES PROVIDED BY THE EXECUTIVE BRANCH, THE LEGISLATIVE BRANCH, AND THE JUDICIAL BRANCH???????????????

    Also, ask them whether they have heard of the “Candy Wrapper Song” case decided by the FCC, where the FCC sanctioned a San Diego, California radio station for broadcasting a song containing words such as “Almond Joy”, “Tootsie Roll”, etc.?????

    Don’t you think that accusing Chinese men of having little “Egg Rolls” are worse than “Tootsie Rolls”, and therefore sanctionable by the FCC for such indecent words?

    also tell them, BY THE WAY, JUST IN CASE IF YOU HAVE NOT HEARD OF THE “PACIFICA” DECISION BY THE U.S. SUPREME COURT, HERE IS THE DEFINITION OF INDECENCY ACCORDING TO THE SUPREME COURT JUSTICES SINCE 1978:

    “INDECENT BROADCASTS” = “LANGUAGE OR MATERIAL THAT, IN CONTEXT, DEPICTS OR DESCRIBES, IN TERMS PATENTLY OFFENSIVE AS MEASURED BY CONTEMPORARY COMMUNITY STANDARDS FOR BROADCAST MEDIUM, SEXUAL OR EXCRETORY ACTIVITIES OR ORGANS.”

    Tell them that by contemporary community standards in 1907, before the repeal of the Chinese Exclusion Act, what CBS Radio did (”spicy ass”, “egg roll” in referring to Chinese) would arguably not be patently offensive, even though it would have been patently offensive to use those words in referring to people of Irish descent, because 100 years ago, it would be reasonable to make fun of Chinese.

    Remind them that this is year 2007, and the “contemporary” community standards in 2007 dictates that the term “spicy ass,” regardless of whether such term are used against Americans of Irish descent or Chinese descent, would be equally as “indecent”.

    If they don’t like the Supreme Court’s 1978 Pacifica decision, tell them to hire a good lawyer to go back to the United States Supreme Court and ask the justices to reverse their 1978 decision and come up with a more modern definition of “indecency” that is applicable to everyone–no double standard.

    Therefore, it is better to have an EGG ROLL instead of a HOT DOG.

    Asking CBS Radio to fire JV and Elvis is not the right approach, and gives CBS the opportunity to use JV and Elvis as scapegoats, instead of focusing on the real issue - Social Responsibility of CBS and other large corporations that intimately affect our daily lives.

    If OCA-NY is somehow successful in getting CBS Radio to fire JV and Elvis, consider the following repercussions:

    1. All of Dog House fans will be angered. Most Americans will side with Dog House fans and view OCA-NY as an unreasonable, combative and anarchist organization with a mission to overturn the Bill of Rights guaranteed by the United States Constitition.

    2. BenBenXiong will feel very guilty for being the Ming Pao Daily reader who brought Dog House “Chinese Food” to the attention of OCA-NY. Given that I am a conscientious person, and believe that firing JV & Elvis without cause constitutes WRONGFUL DISCHARGE, I will have to apologize to JV & Elvis and their extended family for having indirectly and unintentionally caused them to be the target of this controversy, when OCA-NY is barking at the wrong tree. I makes me wonder who are the “Wild Dogs” in this controversy. Calm is cool. CALM IS COOL. Cool down a little bit, everyone. Take it easy. Stop being PURITANS, and try to force the other 95% of American citizenry into Pilgrims of the 21st Century and be compelled into moving to China or Korea or Cuba or Mexico or back to the Old World in order to flee persecution and intolerance from Dog-beating hypersensitive mobsters.

    3. OCA-NY will lose members. Even Chinese Americans will shy away from OCA-NY.

    4. BenBenXiong will resign from OCA-NY Advisory Council. This clearly does not matter to OCA-NY’s President, as she has “accepted” my resignation even though I have been too busy to draft a resignation letter and a press release because of my attempts in trying to quell this Madness.

    Be a Wild Dog. Don’t be a Mad Dog or Rabid Dog. Wild Dogs are Independent, Libertarian, and Pursuers of Happiness. Wild Dogs do not attack each other for no reason.

    Mad Dogs and Rabid Dogs are in need of medical attention from Veterinarians. When proper healthcare still cannot cure their psychosomatic illness, the other alternative is to put them into exile or permanent sleep.
